Description of Service

OneTapp provides a Software-as-a-Service (SaaS) platform that enables businesses to automate, manage, and scale their communications via the WhatsApp Business API. The Service may include features such as automated messaging, contact management, analytics, and third-party integrations.

Account Registration and Eligibility

To use OneTapp, you must register for an account. By registering, you confirm that:

• You are at least 18 years old or the age of legal majority in your jurisdiction
• You have the legal authority to bind the business or entity you represent to these Terms
• All information provided during registration is accurate, current, and complete

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

Early Access Notice

The Service may currently be provided in a testing or early access phase. Features may change, be updated, or be limited during this period.

Acceptable Use and Restrictions

You agree to use the Service only for lawful business purposes and in compliance with applicable laws and regulations.

You agree not to:

• Violate WhatsApp’s Commerce Policy or Meta’s Developer Policies
• Send unsolicited marketing messages, spam, or abusive content
• Transmit illegal, defamatory, or infringing material
• Attempt to reverse-engineer, hack, or compromise the platform
• Resell or distribute the Service without prior written consent

We reserve the right to suspend or terminate your account if these terms are violated.

Subscription, Billing, and Payments

OneTapp may introduce subscription-based pricing and paid plans in the future. At this stage, the platform may be provided as part of an early access or testing phase, and payment features may not yet be fully implemented.

Where applicable, details of pricing, billing, and subscription terms will be made available on the website prior to activation of paid services.

Intellectual Property Rights

All intellectual property rights in the Service, including software, design, and content, remain the exclusive property of OneTapp.

You retain ownership of any data or content you provide (“User Content”). By using the Service, you grant OneTapp a limited license to process and transmit such content solely for the purpose of providing the Service.

Third-Party Integrations (WhatsApp / Meta)

The Service integrates with the WhatsApp Business API provided by Meta.

• We are not responsible for downtime or changes caused by Meta or WhatsApp
• If your WhatsApp account is restricted or suspended due to policy violations, OneTapp is not liable

Limitation of Liability

To the maximum extent permitted by law, OneTapp shall not be liable for indirect, incidental, or consequential damages, including loss of profits, data, or business opportunities.

Our total liability shall not exceed the amount paid (if any) for use of the Service within the preceding three months.

Warranties and Disclaimers

The Service is provided on an “as is” and “as available” basis. We do not guarantee uninterrupted or error-free operation and disclaim all implied warranties to the extent permitted by law.

Termination

You may terminate your account at any time. We may suspend or terminate access if you violate these Terms. Upon termination, access to the Service will cease.

Governing Law

These Terms are governed by the laws of the State of Kuwait.

Any disputes shall be subject to the jurisdiction of the courts of Kuwait.

Changes to Terms

We may update these Terms from time to time. Continued use of the Service after updates constitutes acceptance of the revised Terms.
